This Thursday is the bi-weekly Thursday chat. Last Friday I read a blog offthewedge that has haunted me since. The current blog contains a review of Julie Cohen’s new article on “How (Not) to Write a Privacy Law.” For thirty years, I have been seeking sensible governance that permits new knowledge creation in a respectful manner. Yet there is a growing chorus that knowledge creation is the seed-bed for manipulation. The fact is that we know how not to write this legislation; it is the flip, i.e., how to write this legislation that facilitates a civil society, that is so hard. An old addition of offthewedge drove me back to Giovanni Buttarelli’s “Privacy 2030” published after his death. It includes the quote, “Data defines individuals and determines how they can be treated. The terms of service therefore become, in effect, the law.” Without new law that is definitely the case.
